CBD is legal in Europe in general, since its beneficial effects have been acknowledged by distinguishing it from THC. Unlike THC, that may cause paranoia anxiety and in general mental alteration, CBD contributes to the well-being of body and soul.

The EU dealt with the matter issuing first a Regulation (2013/1307/UE) and the year after a Directive (2014/639/UE). In both cases the European legislator did not specifically address the lawfulness of CBD flower, but by asserting that industrial hemp productions are legally allowed exclusively if the THC level of the flower buds lays below 0.2%, it implies that high CBD hemp strains are not forbidden if these products don’t present THC in a higher percentage. Nothing is said about hemp cultivation at home, which is therefore to be considered illegal.

Ireland not only agreed with the European regulation and fixed the limit for THC content below the same percentage but addressed the CBD issue directly. After the observation of the therapeutic properties of CBD, the latter has been included in the drug register.
